Content Provider Agreement

This Content Provider Agreement is a binding electronic written agreement between HTMLGAMEDEVS SRL, operating FansLess (“FansLess”), and each Creator who submits, uploads, streams, publishes, or otherwise provides content to FansLess (“Creator”).

  1. Creator eligibility and verification

The Creator confirms that they are at least 18 years old and legally able to enter into this Agreement. Before the Creator may upload content, FansLess must verify the Creator’s identity and age using a valid government-issued identification document and appropriate measures confirming that the document belongs to the Creator.

The Creator must provide truthful, complete, and current information and must cooperate with any additional verification requested by FansLess.

  1. Persons depicted in content

For every person depicted, heard, or otherwise identifiable in submitted content, including the Creator, the Creator represents, warrants, and agrees that:

a. The person was at least 18 years old when the content was produced;

b. The Creator has verified that person’s identity and age using valid government-issued identification;

c. The Creator has obtained and keeps a written, signed consent and release from that person;

d. The written consent expressly authorizes the person to be depicted in the content;

e. The written consent expressly authorizes the content to be uploaded to FansLess and publicly displayed and distributed through FansLess;

f. If downloading is enabled for the content, the written consent expressly authorizes users to download the content; and

g. The Creator can provide the identity, age, consent, and release documentation to FansLess promptly upon request.

Content must not be submitted if any required consent has been withdrawn, is disputed, is invalid under applicable law, or cannot be documented.

  1. Creator’s content and likeness consent

The Creator expressly consents to FansLess hosting, reproducing, processing, displaying, communicating, distributing, and promoting the submitted content, including the Creator’s name, image, likeness, appearance, and voice, as necessary to operate and promote the FansLess service.

The Creator grants FansLess a non-exclusive, worldwide licence to use the submitted content for these purposes while the content is available through FansLess and for any additional period reasonably required for legal, compliance, fraud-prevention, recordkeeping, and dispute-resolution purposes.

  1. Prohibited content

The Creator must not upload, stream, distribute, promote, request, or sell content that is illegal or violates the FansLess Content Standards. Prohibited content includes, without limitation:

  • Content depicting or involving anyone under 18;

  • Child sexual abuse or exploitation material;

  • Non-consensual, coerced, trafficked, stolen, secretly recorded, or unlawfully distributed content;

  • Content depicting rape, sexual assault, physical abuse, trafficking, incest, bestiality, extreme violence, or other illegal conduct;

  • Content for which required identity, age, ownership, or written-consent documentation is unavailable;

  • Content violating intellectual-property, privacy, publicity, or other third-party rights; and

  • Content otherwise prohibited by law, the Terms, payment-network standards, or FansLess policies.

  1. Review before publication

Every submission is held in a pending-review status and remains unavailable to the public and other users until FansLess completes its pre-publication review and approves it. Submission does not guarantee approval or publication.

FansLess may reject, disable, or remove content, request further documentation, suspend the Creator’s ability to upload, terminate the Creator’s account, or report suspected illegal activity to relevant authorities and financial partners.

  1. Records and cooperation

The Creator must securely retain the required identity, age, consent, release, and ownership records for every depicted person and provide them to FansLess promptly upon request. Providing false, altered, incomplete, or misleading documentation is a material breach of this Agreement.

By affirmatively accepting this Agreement electronically, the Creator confirms that they have read, understood, and agreed to all of its provisions
